Проблема Совершенствования Норм Об Ответственности За Убийство В Связи С Осуществлением Лицом Специальных Функций

Abstract

В статье рассмотрены проблемы, возникающие при квалификации убийства, совершенного в связи с выполнением лицом служебных обязанностей или осуществлением общественных функций. Предметом исследования являются статьи 105, 277, 295, 317 УК России. Обосновывается необходимость унификации уголовной ответственности за убийство в связи с осуществлением различными лицами специальных функций в однотипных ситуациях. Исключение делается для норм об ответственности за посягательство на жизнь главы государства и его возможного приемника: в главу 29 УК РФ "Преступления против основ конституционного строя и безопасности государства" предлагается включить специальную норму об ответственности за указанное преступление, исключив квалификацию этого преступления по ст. 277 УК РФ «Посягательство на жизнь государственного или общественного деятеля»).
