Защита Участников Рынка Строительных Материалов От Недобросовестной Конкуренции

Abstract

Статья посвящена исследованию способов защиты участников российского рынка строительных материалов от недобросовестной конкуренции. Общие принципы такой защиты установлены в статье 10 ГК РФ. Однако существует и специальный закон, Федеральный Закон РФ «О защите конкуренции», устанавливающий особые правила ведения конкурентной борьбы и способы обеспечения добросовестности ее ведения. Автор исследует законодательное определение конкуренции, а также те ее виды, которые законодатель относит к недобросовестной конкуренции. Законодатель предусмотрел несколько способов защиты добросовестной конкуренции, которые исследуются в рамках статьи, включая принудительное разделение юридического лица, или выделение из его структуры одного или нескольких юридических лиц, в случае злоупотребления доминирующим положением на рынке. Что же касается защиты от недобросовестной конкуренции участников рынка строительных материалов, то проведенное исследование привело автора к выводу о том, что такая защита осуществляется в рамках общих правил о защите добросовестной конкуренции.
