Ускорение Судебного Разбирательства Общее Направление В Развитии Уголовно-Процессуального Законодательства Беларуси И России

Abstract

Одним из современных мировых направлений развития уголовно-процессуального законодательства является ускорение производства по уголовному делу в суде. Россия и Беларусь определились со своими путями совершенствования УПК в данном направлении, соответственно создав институты особого порядка судебного разбирательства и сокращенного порядка судебного следствия. В статье проводится сравнительный анализ двух видов сокращенных судопроизводств, на основе которого делается вывод об их общих и отличительных характеристиках. Особое внимание уделяется наиболее проблемным вопросам, предлагаются пути их разрешения. Пробелы и коллизии законодательного регулирования данных производств предлагается устранить посредством учета опыта каждой страны в их применении, а также совершенствования посредством сближения уголовно-процессуальных систем при создании Союзного государства.
