Соблюдение Процессуальных Прав Лиц, Обвиняемых В Совершении Преступлений Террористического Характера

Abstract

В условиях возрастающего количества преступлений террористического характера перед Российской Федерацией встал вопрос об общей концепции антитеррористической политики, особенно в сфере уголовного процесса. Ряд государств, в основном, англо-саксонской правовой системы, на законодательном уровне сужают процессуальные права лиц, обвиняемых в актах терроризма, по сравнению с обвиняемыми в совершении преступлений иных категорий. Законодателя оправдываются целесообразностью сворачивания прав и законных интересов террористов в пользу спасения жизней миллионов людей. Российская Федерация должны выбрать иной путь: при формировании дифференцированной формы уголовного судопроизводства необходимо сохранить всю систему гарантированных прав обвиняемых. Соблюдение демократических принципов в уголовном процессе по делам о преступлениях террористической направленности ни в коей мене не препятствуют установлению истины по уголовному делу.
