Защита Законного Интереса Личности Как Назначение Уголовного Судопроизводства России

Abstract

Речь в статье ведется о защите категории законных интересов личности в отечественном уголовном судопроизводстве как назначения уголовного судопроизводства. Автор отмечает отсутствие легального определения данной правовой категории в российском уголовно процессуальном законодательстве, приводит мнения ученых процессуалистов, посвятивших свои труды изучению данного правового феномена. В статье раскрыты основные признаки, присущие законному интересу личности, рассмотрено соотношение законного интереса личности с субъективными правами, рассмотрен вопрос о необходимости нормативного закрепления последних для совершенствования мер защиты и отстаивания законного интереса. На основании сравнительного анализа мнений ученых и собственной позиции предлагается авторская дефиниция законного интереса личности в уголовном судопроизводстве.
