Abstract

В статье рассматриваются актуальные вопросы правовой регламентации возвращения уголовного дела прокурору, для устранения допущенных на стадии предварительного расследования нарушений, анализируются дискуссионные проблемы влияния правовых позиций Конституционного Суда Российской Федерации на правоприменительную практику функционирования данного института.
