Юридический Факт Как Образ Обстоятельства Реальной Действительности

Abstract

В статье автор рассматривает одну из традиционных проблем юридической науки – понятие и содержание юридических фактов. Сложившееся представление о юридических фактах как фактах реальной действительности, с которыми нормы права связывают наступление юридических последствий, не даёт представления об их подлинном назначении и роли в правовом регулировании. Утверждается, что юридический факт представляет собой не более чем образ обстоятельства реальной действительности.
