Реабилитация В Уголовном Процессе: О Её Сущности И Содержании

Abstract

что следует понимать под «реабилитацией» в уголовном процессе: «право» каждого лица на устранение и заглаживание вреда, причинённого ему в связи с незаконным уголовным преследованием, или «реальное возмещение» такого вреда либо «реабилитация» это признание незаконности осуждения и (или) уголовного преследования человека и гражданина, влекущее восстановительные процедуры? Законоположения УПК Российской Федерации и Республики Казахстан по обозначенному предмету концептуально различны. Вместе с тем, наличие существенных противоречий в каждом из национальных УПК заставляет усомниться в разработанности на должном уровне заявленных правовых позиций.
