Правовое Регулирование Права Граждан На Свободу Ассоциаций Как Элемента Социальной Самоорганизации

Abstract

Статья посвящена актуальной теме правового регулирования процессов социальной самоорганизации. Автором проанализированы нормы международного права и законодательства Российской Федерации, рассмотрены особенности правовых актов, регламентирующих порядок создания и деятельности общественных объединений, политических партий, местного самоуправления и ряда других проявлений самоорганизации. В статье рассмотрен вопрос совершенствования нормативно-правовой базы ассоциации граждан, проанализирован ряд проблем, связанных с её несовершенством, выработаны предложения о необходимости сбалансированности императивных и диспозитивных норм, регулирующих общественные отношения в этой сфере. Научное и практическое значение статьи связано с возможностью совершенствования правового регулирования процессов ассоциации граждан и социальной самоорганизации в целом, а также их использовании в интересах повышения эффективности государственного и муниципального управления.
