Abstract

При оценке сложных, неоднозначных юридических ситуаций, особенно в отсутствие прямого нормативного регулирования, взгляд конкретного правоприменителя на сущность права напрямую влияет на разрешение юридической ситуации. В связи с этим возможны случаи, когда одна и та же правовая ситуация может быть разрешена по-разному в зависимости от правопонимания судьи.
