Abstract

В статье рассматриваются проблемы правового регулирования наказания в виде ссылки в СССР в период изменения уголовного законодательства конца 1950-х 1960-х годов. Автор приходит к выводу, что новое уголовное и исправительно-трудовое законодательство весьма детально регламентировало условия и порядок назначения и исполнения этого вида наказания, причем исключалась подмена ведомственными нормами общесозных, как это было в отношении регулирования процедуры исполнения ссылки в период 1930-х середины 1950-х гг. Автор полагает, что с момента принятия Основ уголовного законодательства 1958 года отчетливо выявилась тенденция к сужению круга преступлений, за совершение которых предусматривалось наказание в виде ссылки.
