Abstract

Правильное понимание криминалистической характеристики незаконных банкротств позволяет следователю верно определить направление расследования в рамках выдвинутых и проверяемых версий, установить предмет доказывания по делу, знать условия функционирования субъектов предпринимательской деятельности, иметь представление о криминогенной ситуации в регионе и нормативно-правовом регулировании правоотношений в сфере банкротства, выявить деловые и моральные качества сотрудников, осуществляющих конкурсное производство и управленческие функции по наблюдению за сферой банкротства. Подобное положение вещей подчеркивает актуальность исследования в рассматриваемой области, а также требует объективного анализа процесса применения уголовных норм при криминальных банкротствах.
