Abstract

В статье дан краткий обзор современной концепции lex mercatoria, а также особой отрасли lex mercatoria, регулирующей отношения участников международного финансового рынка. Определены ключевые особенности lex mercatoria и его основные источники, в том числе источники в области финансовых рынков. Описано соотношение lex mercatoria и законодательства о рынке ценных бумаг. Автор оценивает влияние на признание lex mercatoria в России как особого метода регулирования, которое окажет недавно вступившая в силу ст. 51.5 Федерального закона от 22.04.1996 №39-ФЗ «О рынке ценных бумаг».
