Признание Организации Банкротом Арбитражным Судом: Обязательное Или Необязательное Условие Привлечения К Уголовной Ответственности За Преднамеренное Банкротство (Ст. 196 Ук Рф)?

Abstract

Статья затрагивает актуальную проблему взаимообусловленности между решением арбитражного суда о банкротстве организации и уголовной ответственностью виновных лиц организации, действия которых повлекли данное состояние. На основании сопоставления мнений ученых автор обосновывает собственную позицию, согласно которой лицо, совершившее действия, предусмотренные в ст.196 УК РФ, подлежит ответственности только в случае, если несостоятельность должника будет установлена и признана арбитражным судом. При этом он замечает, что в случае невыполнения данного условия виновный не может нести ответственность за преднамеренное банкротство.
