К Вопросу Об Уголовной Ответственности За Умышленное Убийство, Совершённое При Превышении Пределов Необходимой Обороны

Abstract

В статье рассматриваются некоторые вопросы уголовной ответственности за умышленное убийство, совершённое при превышении пределов необходимой обороны. Отмечается, что на практике очень часто убийство в состоянии необходимой обороны квалифицируется как умышленное убийство. По мнению автора, в конкретных случаях угрозы жизни или здоровью, причинение вреда обороняющимся посягающему лицу вплоть до лишения его жизни необходимо признать правомерным. Автор считает также возможным освобождение обороняющегося от уголовной ответственности за убийство или причинение тяжкого вреда при превышении пределов необходимой обороны в состоянии аффекта. В связи с этим предлагаются конкретные предложения по внесению соответствующих изменений и дополнений в уголовное законодательство АР и РФ.
