Abstract

Статья посвящена исследованию противоречия специфических императивных норм и публичного порядка в российском праве и практике форумов международного коммерческого арбитража. Данный феномен, по мнению автора, является основанием применения российского права даже в том случае, когда коллизионная норма законодательства или оговорка о применимом праве присутствует в контракте, опосредующем международную коммерческую сделку.
