Abstract

Обсуждается важность соблюдения принципов культуры мышления в законотворчестве. Положения ГК РФ, отражающие авторские права на результат интеллектуальной деятельности, исследуются с точки зрения регистрации прав на публикации и изобретения и правового регулирования отношений диалога «законодатель – гражданин». Обозначены проблемы, связанные с несовершенством ГК РФ в части защиты авторских прав, рассматриваются примеры смысловых некорректностей положений закона. Обсуждаются возможности решения указанных проблем.
