О Необходимости Правовой Классификации Операторов Сети Интернет

Abstract

В отношениях, связанных с использованием цифрового произведения в среде Интернет, участвуют различные субъекты. В статье предлагается правовая классификация таких информационных субъектов, как сервис-провайдеры. Проводится сравнительно-правовой анализ информационного законодательства России, законов США и положений Директивы об электронной торговле Европейского союза 2000/31/EC. Указывается на необходимость введения дополнительных критериев в существующую правовую классификацию лиц, оказывающих услуги в сети Интернет, связанных с предоставляемыми услугами и выполняемыми функциями.
