Abstract

Инновационной деятельности должна способствовать вся система регулирования экономики, все институты хозяйственного законодательства, в особенности регулирующие инвестиционную деятельность. Необходима достаточная стабильность экономической политики и обеспечивающего ее законодательства. Целесообразно использование специальных правовых конструкций и режимов, направленных на стимулирование инвестиций и инноваций. Проблемы правового обеспечения инновационной деятельности нере-шаемы с позиций пропагандируемого некоторыми юристами так называемого частноправового (цивилистического) подхода, который невосприимчив к новым юридическим конструкциям, адекватным современной экономике, не способствует их формированию и применению.
