Регуляторы Поведения Работников В России

Abstract

В статье анализируются нормы трудового права. С точки зрения качества они оказались на довольно низком уровне, поэтому не могут обеспечить нормальный процесс регулирования трудовых отношений, трудовые права и гарантии работников. В статье также дается довольно критический анализ конструкции трудового договора, в котором содержится немало фикций, поэтому его содержание становится неопределенным и расплывчатым. По этой же причине исполнение такого договора становится затруднительным для работников. И тогда главным регулятором поведения работников становится приказ работодателя. Низкое качество правовых норм и наличие фикций в договоре приводят к различным травматическим последствиям в поведении работников: риск утраты работоспособности, риск оказаться без защиты нарушенных прав. Государственные гарантии трудовых прав работников на практике оказываются слабыми средствами, так как они не обеспечены достаточным количеством правовых норм на уровне закона и юридической ответственностью работодателей за их нарушение.
