Феномен Смешанных Правовых Систем Как Пример Сближения Правовых Культур

Abstract

Рассмотрены некоторые вопросы, связанные с проблемами осмысления феномена смешанности правовых систем. Целью исследования является рассмотрения перспектив развития правовых гибридов как теоретической, так научно-практической единицы. Дается краткий экскурс зарождения смешанных правовых систем как объекта сравнительно-правового исследования. Автором приводятся различные подходы к пониманию «смешанности» правовых систем, а также анализируется мнения ученых, касаемо сущности таких систем, их составных элементов, а также критериев классификации правовых систем как смешанных. На основе проведенного исследования автором предлагается выделить ряд основных положений, требующих особого внимания и анализа при дальнейшей разработки данной проблематики в рамках сравнительно-правовой доктрины.
