Abstract

Рассмотрены существующие способы защиты прав предпринимателей при выполнении государственных и муниципальных контрактов от несвоевременной оплаты поставленных товаров, оказанных услуг и выполненных работ. Выявлены недостатки механизмов обеспечения исполнения обязательств по данной категории договоров. Определены направления совершенствования механизма расчета и взыскания неустойки по государственным и муниципальным контрактам. Предложены альтернативные способы защиты интересов предпринимателей и бюджетных средств.
