Хранение Вещественных Доказательств По Действующему Уголовно-Процессуальному Закону: Необходимо Системное Совершенствование

Abstract

В статье с учетом лингвистического, нормативного и исторического аспектов рассматривается проблема понятия хранения вещественных доказательств. Обратившись к уголовно-процессуальному законодательству, действовавшему в России ранее, автор проследил становление системы норм, регламентирующих в настоящее время порядок хранения вещественных доказательств. Автор доказывает несовершенство данной системы, поскольку она охватывает нормы, регламентирующие действия, направленные не на сохранение свойств и признаков вещественного доказательства, а на выведение его из сферы уголовного судопроизводства. Сформулировано предложение по внесению в Уголовно-процессуальный кодекс Российской Федерации изменений, устраняющих алогичность его норм в части регламентации порядка хранения вещественных доказательств.
