Abstract

В качестве одного из видов вреда, который может быть причинен личности, в законодательстве выделяется моральный вред, т.е. страдания, вызванные различными неправомерными действиями (бездействием). Российское законодательство предусматривает возможность взыскания денежной компенсации за причиненный моральный вред. Однако суды крайне неохотно применяют нормы о такой компенсации в сфере защиты прав потребителей, что не соответствует мировой практике и реальному положению вещей в конкретной ситуации (степени страданий гражданина).
