Abstract

Статья посвящена развитию правового регулирования холдингов в России с учетом вступивших в силу нововведений в Налоговый кодекс, в соответствии с которыми введено понятие консолидированной группы налогоплательщиков (КГН) и уточнено понятие взаимозависимых лиц, причём оба этих понятия с экономической точки зрения в некоторой степени близки понятию холдинга, однако понятие КГН ýже, а взаимозависимых лиц — шире понятия холдинга. Для холдингоподобных объединений вводится особый налоговый контроль, носящий в том числе антиоффшорный характер. Одновременно вводятся меры, стимулирующие фактические холдинги к формализации.
