Правовая Определенность: Формальный И Материальный Аспекты

Abstract

Одним из важнейших конституционных требований к правовому закону является требование его правовой определенности. Однако данное требование не ограничивается определенностью правовой формы, но предполагает учет материального или фактического аспекта определенности права. Теоретический анализ. В статье рассматривается правовая определенность через дихотомию ее формального и материального аспектов. Автор приходит к выводу, что характерный для отечественной юриспруденции подход к праву как форме не является гносеологически бесспорным. Результаты. Исходя из проведенного анализа, автор выделяет различные аспекты формальной и фактической определенности в праве, а также обосновывает необходимость расширения инструментальной базы науки теории права и конституционного права. В частности, в качестве одной из перспективных гносеологических парадигм выступает социокультурный подход к праву.
