Право На Уважение Частной Жизни: Международные Стандарты Реализации И Защиты

Abstract

Одним из важнейших прав человека и гражданина, гарантированных Конституцией Российской Федерации и основополагающими международно-правовыми актами, является право на уважение частной жизни. Теоретический анализ. В статье рассматривается содержание права на уважение частной жизни. В соответствии с Конституцией Российской Федерации права и свободы человека и гражданина признаются и гарантируются согласно общепризнанным принципам и нормам международного права. В этой связи анализируется данное право, исходя из смысла, который придается ему международными правовыми актами и межгосударственными органами (преимущественно Европейским судом по правам человека). Результаты. На основе проведенного анализа выделяется комплекс прав, свобод и отдельных правомочий, которые составляют сущность конституционного права на неприкосновенность частной жизни.
