Abstract

Статья посвящена проблемам, возникающим в процессе определения и назначения наказания в виде лишения свободы. Лишение свободы на определенный срок является самым часто назначаемым и применяемым видом уголовного наказания. С учетом проблем, связанных с переполненностью пенитенциарных учреждений, а также направленностью уголовно-правовой политики на смягчение, важно правильно подходить к выбору и назначению данного вида наказания.
