Личность Преступника, Совершающего Преступления В Сфере Компьютерной Информации

Abstract

В статье рассматривается проблема общего анализа личности преступника, совершающего преступления, предусмотренные в гл. 28 УК РФ. Представлена типовая классификация этих лиц, дан их криминологический портрет, выявлены основные признаки, влияющие на преступное поведение и обусловливающие противоправный выбор. При исследовании криминологического портрета применялся комплексный подход, позволяющий учитывать биофизиологические, социально-демографические, психологические, нравственные, социально-ролевые, уголовно-правовые и криминологические факторы развития человека. Знание свойств личности поможет не только сформировать необходимую доказательственную базу по уголовным делам в сфере компьютерной информации, но и выявить обстоятельства, способствующие совершению преступления.
