Abstract

В статье исследуется практика внедрения классовых принципов в советскую уголовную политику в 1920-е годы. В частности, анализируются теоретические и практические аспекты применения классовых принципов в судебной практике и системе наказаний. Делается вывод о том, что политизированное общество рождало и политизированное право, отличительным признаком которого являлся классовый подход к определению принципов системы наказаний. Это свидетельствовало о том, что идеология имела приоритет перед законом.
