Судебный порядок разрешения трудовых споров в Советском государстве в 20-е годы xx века: опыт правового регулирования

Abstract

Статья посвящается вопросу создания системы судебных органов по разрешению трудовых споров в Советском государстве в период нэпа. Автором показывается, что в начале 20-х гг. XX в. предпринимались попытки выделить трудовую юстицию в самостоятельную, функционирующую по особым правилам и доступную для граждан систему юрисдикционных органов. Однако идея формирования трудовых судов не была воплощена на практике. Законодатель, узаконив трудовые сессии народных судов, включил их в общую систему правосудия, а сами трудовые споры в основном рассматривались по правилам гражданского процесса. При этом действовавший в 20-е гг. XX в. судебный порядок разрешения трудовых споров вызывал немало нареканий в силу своей сложности и противоречивости. В работе также обращается внимание не только на отрицательный, но и на положительный опыт в деятельности трудовых сессий, который может оказаться полезным в современных условиях.
