E-commerce: Cyberlaws and Protection of lPRs

Abstract

Legal framework is an integral part of e-environment. Is the antiquated Indian legal system geared to deal with issues emerging from e-commerce ? Can the Information Technology Act provide the necessary safeguards for e-commerce? This article attempts to address such questions focusing on the needs of the electronic medium and users. Besides, it provides reasons for introducing an efficient, flexible, technologydriven and globally conducive legal regime for e-commerce. It highlights the gaps and shortcomings of the IT Bill 1999 and also the missing links in the existing legal system to deal with e-commerce in India. It also attempts to address the issues related to protection of intellectual property rights on the electronic medium. Other legal issues covered in this article are the rights of the e-worker, e-employer and e-enterprise. The IT Bill 1999 is just a beginning, the Indian legal system is in for some drastic changes in the near future if India plans to be a visible location on the e-highway.
