Legal structure of comparable markets in the Russian antimonopoly legislation

Abstract

One of the key areas of antitrust policy is to counter abuse the of dominant position. Among the most dangerous forms of abuse of dominant position - fixing and maintaining monopolistically high prices. In Art. 6 of the Law "On Protection of Competition" it is supposed to use two criteria for the assessment of the economic entity established as a monopoly high prices, including - comparable markets in a competitive environment. However, in practice the application of this provision, there is considerable difficulty in qualifying as the commodity markets comparable, which can not influence the risk of errors types I and II and, accordingly, the deterioration of the characteristics of the legal system to deter the activities, which results in a restriction of competition and losses in efficiency (loss benefit consumers). This article focuses on the economic assessment of the legal structure "comparable markets" in the Russian anti-monopoly legislation in the context of international experience of its application.
