Abstract

Neither the wording nor the protective purpose of the standard of § 284 I of the German Criminal Code require an authorization. Therefore, the question arises if a foreign authorization has a legal effect, especially if a foreign permission is a permission according to § 284 I StGB - Strafgesetzbuch (german penalty code). This question initially requires a differentiation whether it is an authorization from an EU-Member State or a non-EU-Member State. In this case, it is disputable if an approval of an EUMember- State has a legal effect or not.
