Abstract

Certaines pratiques bancaires et financières Islamiques contemporaines ont soulevé des controverses juridiques qui éliminent toute différence substantielle entre ces dernières et leurs homologues conventionnelles. Ces pratiques tirent leur légitimité du simple respect des exigences contractuelles en termes de forme et de structure, loin de la considération et de l’analyse du fond et du contenu des contrats. Ces pratiques controversées des banques Islamiques sont considérées comme une menace pour cette industrie naissante, et elles ont en quelque sorte conduit à la distorsion de la religion aux yeux d’un public averti et aux yeux des nonmusulmans. Cet article examine, à travers une approche Maqassidi, les modes de financement les plus controversés qui sont adoptés par les différentes institutions financières Islamiques, et analyse les diverses justifications appuyant leur légitimité. L’article décrit également le prospectus de ce qui constitue un véritable produit compatible avec la Chari‘ah.
