Abstract

[eng] The Evolution of Public Service and Subsidiarity Principle. This paper discusses the modernization of the french public service. To study this subject, we have deliberately adopted an evolutionary approach. Then in this perspective, can we defend "le service public à la française" on identity and cohesiveness principles or take another way that proposes a total liberalisation even if we sacrify egality and solidarity ? This paper shows that a modern public service, combining efficiency and equity, is a proximity one, based openly on the subsidiarity principle. Cet article s'intéresse à la modernisation du service public français. Pour aborder ce sujet, nous avons jugé nécessaire de retracer l'évolution de la notion de service public. Dans cette perspective, fàut-il au nom de l'identité et de la cohésion nationales défendre « le service public à la française », ou au contraire aller vers une libéralisation totale, au risque de sacrifier les principes fondamentaux d'égalité et de solidarité ? Au vu de cette évolution, l'article cherche surtout à montrer qu'un service public moderne, conciliant efficacité et équité, est un service public de proximité s'appuyant ouvertement sur le principe de subsidiarité. Nous prenons comme exemple de service public subsidiaire, le cas de l'eau.
