Abstract
[fre] La littérature économique s'est surtout employée à analyser l'efficience des dispositifs de droit d'auteur, soit de façon théorique en référence à la théorie du wel-fare, soit de façon plus empirique en analysant le fonctionnement des dispositifs de gestion de ces droits d'auteur. Mais elle s'est peu intéressée à l'importance de la définition de l'auteur et de l'œuvre dans ces dispositifs. Notre contribution met en lumière les enjeux économiques de ces définitions dans l'efficacité des systèmes de droits d'auteur. Les évolutions artistiques et technologiques ont contribué à faire de la création artistique une opération de plus en plus collective débouchant sur une multiplicité d'auteurs. Les stratégies développées par les différents acteurs pour se voir reconnu le statut alourdissent les coûts de transaction et augmentent les risques de conflits. [eng] Economic literature has above all sought to analyze the efficiency of the copyright system, either from a theoretical viewpoint on the basis of the theory of welfare, or from a more empirical viewpoint, analyzing how the system for managing copyright issues actually operates. But it has paid scant heed to the importance of the definition of the author and the work within these systems. Our contribution sheds light on the economic stakes of these definitions in terms of the efficacy of systems of copyright. Both artistic and technological developments have contributed to making artistic creation an increasingly collective practice, leading to a multiplicity of authors. Strategies deployed by the various actors to be recognized as authors have increased the transaction costs and the risk of litigation.
