Abstract

[fre] Le contrat est une notion juridique fonctionnelle visant principalement à l'échange des biens et des services. C'est un accord de volontés destiné à produire des effets de droit dont la force obligatoire dépend de sa conformité au droit objectif. Il doit être conforme à ses finalités objectives, l'utile et le juste. De la première se déduisent les principes subordonnés de sécurité juridique et de coopération et de la seconde la recherche de l'égalité des prestations par le respect d'une procédure contractuelle effectivement correcte et équitable. [eng] Contract is a fonctional notion. His most important goal is the exchange of goods and services. It is a bilateral consent of wills to this end of create some juridical effects. It is compulsory only if it is conform with objective Law, i. e. to his objective finalitys : utility and justice. From the first one results the subordinate principles of security and cooperation and from the second one the research of equality of the exchange by a procedure effectively fair.
