Abstract
[eng] We consider the case of a Cournot oligopoly in which two technologies for the production of a homogenous good are available. One of these generates pollution and we study regulator using a technological standard accompagning by monitoring. We show that paradoxically it is in those oligopolies that respect the standard most that the regulator should monitor most closely if he wishes to maintain a constant level of compliance when new firms enter the industry. We also show that if the damage and cost functions are convex it may then be optimal to let certain firms violate the standard : the fact that there is imperfect information enables in fact discrimination to be used in this case between homogeneous firms and this allows the technological standard to yield an optimal level of pollution in the neo-classical theorical sense. [fre] Considérant le cas d'un oligopole à la Cournot produisant un bien homogène où deux technologies sont disponibles, une étant génératrice de pollution, nous étudions le cas d'une régulation par une norme de procédé accompagnée d'une politique d'audit. Nous montrons que c'est paradoxalement dans les oligopoles les plus respectueux des normes de procédé que le régulateur devra intensifier sa politique d'audit s'il désire maintenir un niveau de respect constant lorsque des firmes viennent agrandir la taille de l'industrie. Nous montrons également que si les fonctions de dommage et de coût sont convexes, il peut alors être optimal de laisser certaines firmes transgresser la norme : le contexte d'information imparfaite permet en effet de pratiquer dans ce cas une discrimination entre firmes homogènes, et permet à la norme de procédé d'atteindre un niveau de pollution optimal au sens de la théorie néo-classique.
