Suveranitate nationala/administrativa nationala versus cooperare administrativa interstatala

Abstract

Obiectivul acestui studiu este de a starni o dezbatere care sa coopteze specialisti in domeniul dreptului public si al stiintelor administrative romanesti si internationale - teoreticieni, practicieni, cercetatori - si se doreste a fi un for de analiza a noilor directii de cercetare cu privire la adoptarea Codului de procedura administrativa in patria noastra unde se resimte acut aceasta nevoie a proceduralizarii din mai multe directii: administratia publica, judecatorii de contencios administrativ si practicienii dreptului administrativ. Mai ales acum in Anul Omagial al unitatii de credinta si de neam si Anul comemorativ al fauritorilor Marii Uniri din 1918, moment aniversar major pe care Romania il sarbatoreste anul acesta, care ofera, poate nu intamplator, prilejul punerii in discutie a unor probleme conceptual juridice si de expresie sociala, aflate, cel putin in ultimele doua decenii in atentia celor interesati de femomenul administrativ. Fiica mea vreau sa aiba ocazia sa construiasca un viitor sigur in Romania; sa studieze, sa se implice in tara sa si sa-si intemeieze o familie. Si cred ca noi cetatenii, trebuie sa preluam controlul asupra ceea ce se intampla in Romania noastra. Vreau o Romanie sigura unde dreptul administrativ - material si procedural - sa faca parte din viata de zi cu zi. Protectia cetatenilor trebuie sa reprezinte prima prioritate. Trebuie consolidata administratia si imbunatatit sistemul judiciar. Suntem unul din ultimele state ale Uniunii Europene care nu are un cod de procedura administrativa in conditiile unei europenizari accentuate a dreptului administrativ. Iar despre Codul administrativ, la data aparitiei acestui studiu, Curtea Constitutionala a Romaniei s-a pronuntat, dupa mai multe amanari asupra neconstitutionalitatii Legii privind Codul administrativ in integralitatea sa.
