Several Issues For The Execution Of Contracts Entered Between Health Insurance Houses And Medical Services Providers

Abstract

The contract between health insurance houses and providers of medical services belongs to a category of contracts regulated by law based on which the provision of public health services is guaranteed. In case such medical services are supplied by these service providers, contracts are being executed between the medical service provider and its beneficiary, the natural person. In this way, the public health service is insured by the state in the case of each person who is entitled to such services. Although in the case of civil contracts, the attachment entered between the health insurance houses and the medical services providers for the achievement of the public health services has generated debates in the legal practice in connection with certain issues of the execution of such contracts. The paperwork establishes the legal framework of the discussed contract and focuses on several particularities of the execution of this contract, such as the force of the contract, liability, the connection between the contract and patient’s rights and aspects concerning litigation, reflected by the jurisprudence.
