The Persons That Can Be Arbitrators In National And International Arbitration

Abstract

This study is intended to analyze the conditions that a person has to fulfil in order to become an arbitrator in national and international arbitration. Both the requirements imposed by the international conventions regarding arbitration, by national legislations and the rules of the main arbitration institutions, but also the selection criteria which can be imposed by the parties are submitted to the analysis. An important aspect regards the impartiality and independence of the arbitrators, requirement that insures the rightful solving of the litigation.
