Le contrôle préfectoral de légalité: entre rupture et continuité

Abstract

Un quart de Siecle après la loi de décentralisation du 2 mars 1982 qui annonçait une rupture avec l’ancien système de la « tutelle », le contrôle de la légalité des actes des collectivités territoriales a marginalisé le juge administratif et a consacré le rôle du préfet. Ainsi remodelée, la physionomie du contrôle apparaît stabilisée depuis la fin des années 1990. Cette régulation administrative est aujourd’hui en voie d’être rationalisée par l’exploration empirique de véritables stratégies de contrôles, ainsi que par l’appui normatif du législateur. Finalement, les 25 ans de pratique de ce contrôle laissent apparaître des éléments de continuité qui nuancent la rupture annoncée en 1982
