Abstract

Au droit du patient de prendre une décision vitale pour sa vie et sa santé lui correspond l'obligation corrélative du médecin de l'informer completement et avec compétence, pour éviter tous les risques possibles. Cette obligation est de nature professionnelle et tient compte de la transparence de la décision médicale, du besoin de loyauté et de la bienséance des partis du rapport juridique a l'égard de la réalisation de l'objectif proposé, plus précisément, la guérison du malade. Étant donné le fait que son information concerne l'activité d'assistance médicale, l'obligation a été appréciée comme accessoire a l'obligation principale de soin et de traitement
