Comments on the subjects of the crime stipulated by Law no. 39/2003 regarding the prevention and fighting against organized crime, considering the changes of the Criminal Code on the criminal liability of the legal person

Abstract

Per mettere in applicazione la Convenzione delle Nazioni Unite contro il crimine organizzato transnazionale, adottata dall’ Assemblea Generale, il 15 novembre 2000, si è adottata la Legge nr. 39/2003 che prevede misure di prevenzione e di contrasto alla Criminalità organizzata. Il reato previsto dall’ art. 7 di questa legge, diverso dal reato di associazione per delinquere di cui all’art. 323 Codice penale, prevede quatro forme di manifestazione. Pensando alle modifiche del Codice penale con l’introduzione della responsabilità penale delle persone giuridiche, dobbiamo vedere come può essere un’ente soggeto di questo reato. Avendo come punto di riferimento la legislazione italiana, consideriamo che sia necessario introdurre la responsabilità delle persone giuridiche qualora le stesse non siano coinvolte nell’attività dell’organizzazione criminale, ma i reati siano commessi nel suo interesse o a suo vantaggio
