The Control of Laws’ Constitutionality in Romania - from Political to Jurisdictional Control

Abstract

The evolution of Romanian constitutionality is also marked by the introduction - it is true by praetorian way - of a jurisdictional control of constitutionality. Thus, in the transfer from a political control of constitutionality to a jurisdictional one, an important role was played by the doctrine and the jurisprudence of that time. It was thus proved that the Romanian specialist - judges as well as other law practitioners and theorists - was under the period’s trends. This paper emphasizes the contributions of doctrine and jurisprudence to the implementation of jurisdictional control of constitutionality
