The political character of the Government Emergency Ordinance within the Romanian transition context

Abstract

The institution of legislative delegation and consequently the possibility of the Government to make laws has resulted into strong arguments over the constitutional law doctrine because of at least two reasons: the institution is an exceptional one and allows the Government to carry out the attributions of another state power – the legislative power – and then, the obvious political character of the legislative delegation, “the political” represented by the legislative power, controls the “political ” represented by the executive power.
