Abstract

Articolul de fata prezinta o analiza plurivalenta a art. 128 cu privire la domeniul cultural, introdus în 1992, în Tratatul de la Maastricht. Importanta prezentei art. 128 în Tratatul instituind Uniunea Europeana rezida în oferirea, pentru prima oara, a unei baze juridice sectorului cultural. Studiul realizat în lucrarea de fata se concentreaza atât asupra punctelor pozitive cat si a punctelor negative care caracterizeaza acest prim articol cu privire la dimensiunea culturala europeana. Totodata complexitatea domeniului cultural la nivel european este urmarita prin analiza unor elemente problematice precum conceptul de „exceptie culturala”, a mecanismului juridic creat si nu în ultimul rând a rolului jucat de statele membre în cadrul acestui mecanism.
