The Effectiveness of Competition Policy in the United Kingdom

Abstract

The paper set out the legal framework and institutions of U.K. competition policy, and analyzes its main strands. It argues that mergers policy, both at the referral and the assessment stage, should be evaluated principally on the basis of impact on competition and that the political role of the Secretary of State should be removed. The paper analyzes the U.K. government's proposals for the reform of Restrictive Practices (White Paper 1988) and Abuse of Market Power legislation (Green Paper 1992). After brief discussion of the connection between Competition Policy and the privatization program, the paper concludes by contrasting the successes of liberalization in the 1980s with the slow pace of legislative reforms.
