Acquiescence or national rules of limitation? Polish Supreme Court addresses time limit for pursuing EUTM’s continuous infringement

Abstract

The Polish Supreme Court has dispelled doubts about the national statute of limitation for non-pecuniary claims arising from continuous infringements. Even though the case involved Audi AG’s frontline EU trade mark (EUTM), the Supreme Court decided on a limitation period under national law, not the EUTM acquiescence.
